Policies and Booking Conditions

We strongly suggest you read and print these conditions before you proceed to final booking. Please note that it is essential to read and understand the conditions of booking below when you book. Please ensure you have read and understood the itinerary and style of the trips you are booking.

By making a booking by telephone, website www.be-outdoors.com or email with BE Outdoors, you accept on behalf of yourself and all those named on the booking including minors and persons with disabilities to be bound by these Terms and Conditions.

These terms and conditions form a contract that will exist between you and BE Outdoors Adventure Travels Private Limited (henceforth known as “BE Outdoors”) when we confirm arrangements via a reservation or booking invoice or email. BE Outdoors accepts bookings subject to the following conditions:

Prices

Standard trip packages include the following:
  • All meals and accommodations
  • Sightseeing and tours
  • Transportation to and from Delhi including local transfers
  • Lead guide services as well as support team as needed
  • All necessary gear and equipment
  • For camping, trip prices include all gear and equipment as well as kitchen crew and porters as needed.
The price of your trip does not include:
  • International / domestic flights
  • Group Kitty
  • Airport transfers, taxes and excess baggage charges unless specified
  • Visa and passport fees
  • Travel insurance
  • Optional activities and sightseeing and all personal expenses
We reserve the right to increase or reduce prices as needed on our website, pricing sheets and brochures. Such changes will not affect the price you pay which is fully guaranteed once we have issued an invoice. However, we do reserve the right to correct any manifest pricing errors on our website or invoice.

Validity

The prices listed are based on the costs and exchange rates current at the time of pricing. BE Outdoors reserves the right to alter these prices at any time. The price of your trip is guaranteed when you have paid in full. The itineraries and dates in the brochure are indicative only and are subject to change. All information in the brochure is accurate to the best of our knowledge, but please note that changes to our trips, itineraries, tours, routes, destinations, trails, etc. (which can be significant) can and do occur. BE Outdoors will make every effort to keep you informed of any changes, but will not be held liable for any alterations made to itineraries. Please refer to our website for the most recent update to any trip.

Cancellation by the Traveller

Loss of money paid applies to all cancelled reservations. The date of trip cancellation is the date on which the written cancellation is received by BE Outdoors.

If you wish to change your booking in any way, the following fees apply:
  1. Greater than or equal to 30 days prior to the program starting date, we will retain a minimum administrative fee of Rs. 1000 for each cancellation.
  2. Within 10 days of the program start date, we will reimburse half, or fifty percent, of the full costs associated with the program. For example, if the program fee is Rs. 5000, then we will retain half the amount or Rs. 2500 and refund you the same, or Rs. 2500.
  3. Within 5 days of the program start date and once the course has begun, your payment is non-refundable
No refunds will be made if you voluntarily leave a trip for any reason after the trip has begun. Refunds will only be provided at the discretion of BE Outdoors if you are involuntarily forced to leave a trip for any reason. No refunds will be made for any accommodation, transport, sightseeing, meals or services not utilised.

Cancellation by BE Outdoors

BE Outdoors reserves the right to decline any booking. BE Outdoors reserves the right to cancel any trip before it is guaranteed to run. BE Outdoors reserves the right to cancel any trip, including a guaranteed trip; at any time prior to departure due to terrorism, natural disasters, political instability, Force Majeure or other external events which makes it unviable for BE Outdoors to operate our planned schedule. If BE Outdoors cancels a group adventure trip on which you are holding a fully paid booking you may choose between an alternative trip of which the balance of your trip will be transferred or you will receive a full refund. If the alternative trip chosen is of a lower value than that originally booked then you are entitled to a refund of the price difference. If the alternative tour chosen is of a higher value then you pay the difference in price. BE Outdoors is not responsible for any incidental expenses that you may have incurred as a result of your booking such as, but not limited to, visas, vaccinations, non-refundable flights, loss of earning or loss of enjoyment, etc.

Booking Amendments

Payment in full is required to reserve your place in any of our programs and payment is non-transferable. If you wish to alter the arrangements requested by you and confirmed by us on our Booking Confirmation, we will do our best to accommodate any changes to your request but this may not always be possible.

Local Payment

Most of our trips require a compulsory local payment, which is part of the contract with you (the customer) and BE Outdoors Adventure Travels Pvt Ltd. This amount is the final payment for your trip and is to be paid in the specified currency, in cash to your leader upon arrival. The local payment is non-refundable, and is considered part of the total trip payment.

Paying locally facilitates the flow of funds to local suppliers in places that we travel through and therefore helps to reduce the overall cost of your trip.

Insurance

Travel insurance is compulsory for all BE Outdoors travellers. Your travel insurance must provide cover against personal accident, medical expenses, emergency repatriation and personal liability. We also recommend it covers cancellation, curtailment and loss of luggage and personal effects. We strongly recommend that you take out travel insurance at the time of booking. We are not responsible for your travel insurance. Insurance is entirely at your discretion and should be considered a contract between you and the provider. BE Outdoors has no liability as it relates to or concerns your travel insurance.

BE Outdoors shall have no liability for loss, theft of or damage to baggage or personal effects. Personal belongings lost or stolen while unattended by you in public lounges or other public areas, whether on board a vessel, train, bus, or other mode of transportation, publicly owned or operated by BE Outdoors or its contract providers , are not reimbursable. Losses due to ordinary wear and tear and other acts of nature are not reimbursable. BE Outdoors cannot accept responsibility for and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by BE Outdoors such as hotels, home-stays, vessels, expedition vehicles, or any other mode of transportation.

Passports and Visas

Foreign travelers must carry a valid passport and have obtained the appropriate visas when travelling with BE Outdoors. Please ensure your passport is valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas for your holiday. BE Outdoors cannot accept responsibility if you are refused entry to a country because you lack the correct visa documentation. Passports and/or other identity verification may be required by BE Outdoors and/or its contract providers for purposes of validation and registration at hotels, home-stays, lodges, etc. and/or on transportation such as bus, rail or other vehicle.

Responsibility

You acknowledge that travel on a BE Outdoors trip requires a degree of flexibility and understand that the trip's route, accommodation and modes of transport are subject to change without prior notice due to local circumstances. Should BE Outdoors deem it advisable to amend an itinerary for any reason, it may do so by shortening, varying or re-routing any trip. These changes are binding and additional expenses will be charged to you if the reason for any alteration is outside BE Outdoors's control.

While travelling with BE Outdoors you agree to accept the authority of the leader and local operator at all times. You are aware that travel within a group may involve compromise to accommodate the diverse desires and physical abilities of group members. You understand that BE Outdoors reserves the right to decline, accept, or retain any person as a member of the group at any time. You acknowledge that BE Outdoors contracts with a network of companies, government agencies and individuals to assist in the running of its tours. To the best of BE Outdoors's knowledge, these third parties are qualified to perform the duties they are contracted to perform. However BE Outdoors will not be held liable for any injury, damage, loss, delay or irregularity that may occur due to the behavior of these third parties. BE Outdoors will not accept responsibility or liability for any traveller who contravenes any law or regulation of the country.

BE Outdoors will not be liable where any failure in the performance of the contract between us is due to:
  • You or a third party (other than one of our suppliers)
  • Unforeseeable, unavoidable or unusual circumstances or events beyond our control or the control of our suppliers, the consequences of which could not have been avoided even if all due care had been exercised.
Our total liability shall not exceed twice the total sum charged for your booking.

Nothing in these terms and conditions affects your statutory rights and in particular nothing in these terms and conditions excludes or limits our liability for any of the following:
  • Death or personal injury caused by our negligence or our suppliers' negligence;
  • Matter in which it would be illegal for us to exclude or attempt to exclude our liability;
  • Fraud or fraudulent misrepresentation.
No employee, servant or agent of BE Outdoors has authority to vary these conditions. This agreement is governed by the laws of the country of India and Delhi, India.

Your Liability

You must notify BE Outdoors in writing during the process of booking of any medical conditions, pregnancy, disability or any other mental and or physical condition which may affect fitness to travel and or any other medical condition. Failure to notify the Company may result in your being refused travel. Failure to notify the Company of any such condition that results in cancellation will have full cancellation fees. Some trips may be unsuitable for you due to age, mobility, disability, pregnancy or physical or mental conditions. It is your responsibility to check prior to booking.

BE Outdoors reserves the right to terminate your booking at any time without making any refund to you and also to claim from you for any loss, damage and / or injury sustained by us, our employees, suppliers, representatives, contractors and/or agents if you or any other member of your party should cause any malicious, willful or negligent damage.

BE Outdoors also reserves the right to terminate your booking at any time without making any refund to you if you or any other member of your party commits any illegal act or behaves in such a way as to spoil other guest’s enjoyment of their booking or to prevent our supplier(s) from delivering services booked by you or any other party.

If BE Outdoors terminates your booking we will usually hold your details and those of all other members of your party within our database and we may refuse any future bookings from you or any other member(s) of your party.

Participation Form

All BE Outdoors travellers on group trips must sign a Participation Form on the first day, Day One (1) of commencement of the trip. Please note that signing the form is a pre-requisite of travelling with BE Outdoors. The wording of this form is as follows.

"I understand that travelling with BE Outdoors may involve risks (and rewards) above and beyond those encountered on a more conventional holiday, and that I am undertaking an adventure trip with inherent dangers. I understand that I am travelling to geographical areas where, amongst other things, the standard of accommodation, transport, safety, hygiene, cleanliness, medical facilities, telecommunications and infrastructure development may not be of the standard I am used to at home or would find on a conventional holiday or destination.

I have read and understood the trip I am undertaking and have provided details of any pre-existing medical conditions I have to BE Outdoors company representatives. I accept these risks and obligations and I fully assume the risks of travel. I release BE Outdoors Travel from any liabilities connected to these risks to the maximum extent permitted by law."


Trip Grading

We have included a range of treks that are suitable for all ages and abilities. All treks are graded on a universal scale. Treks range from easy to moderate, moderate, strenuous and expeditionary or extremely challenging levels.

Easy to moderate: Trek an average of 3 to 4 hours daily on generally gentle to moderate terrain. Distances may be from 5 – 13km or roughly 3 to 8 miles with elevation gains and/or losses range from 150m – 450m or 500 to 1,500 feet.

Moderate:Hike an average of 4 to 5 hours daily on varied terrain with distances from 8 to 15km or 5 to 9 miles. Elevation gains and losses generally vary from 450 – 760m or about 1,500 to 2,500 feet or about 2 hours.

Strenuous: Hike roughly 5 to 7 hours daily on varied to rough terrain, with consistent ascents and descents of 2 to 3 or more hours generally 760 - 1067m or 2,500 - 3,500 feet. Distances vary from 10 - 18km or 6 to 11 miles with some sections that may include steep uphill and downhill and possibly moderate to rough terrain.

Expeditionary/extremely challenging: note: basic mountaineering skills or experience may be necessary depending on the trek. Trekking involves 5 to 8 hours partly on rocky, challenging terrain with consistent steep ascents and/or descents of 2 to 3 or more hours generally 915 - 1520m or 3,000 - 5,000 feet. Distances may range from 10 - 24km or 6 to 15 miles per day. Though each day may not be as strenuous some sections may include rough terrain and open and exposed trails and may require off-trail navigation.

In several trips, BE Outdoors Travel works with highly reputable local operators, providers of services and vendors.

These local partners are all passionate and enthusiastic about the countries they operate in, and offer the same high standards as BE Outdoors. By working closely with these local companies, we are best able to put money back into the local economies through which we travel.

Accommodation

Travelling with BE Outdoors involves the lodging of our guest. Accommodations provided by BE Outdoors varies significantly based on the trip, program, destination, tour, package or adventure. On several trips, the accommodation would comprise camping out in open areas or rooms which have been booked in local guest houses or hotels. In such places, accommodation would be basic. Hotels and lodges on trips offer western style conveniences and amenities as well as boutique-style features. BE Outdoors does not guarantee western-style conveniences or amenities as these will vary by location, destination, package, etc. In addition, BE Outdoors does not guarantee changes or modifications to accommodations as prescribed by the guest. Any changes as appropriate will incur an associated fee and would be adjusted accordingly and applied to the guest.

Open Age

BE Outdoors adventures are primarily designed for travellers of ages 18 and above. Adult travelers allow us to have a group that is cohesive hence allowing for great group dynamics and social interaction. At the same time, some treks would be physically demanding and hence would not necessarily be recommended for people below this age. While we offer trips to individuals under the age of 18, most of our trips require a minimum age of 12. In turn, those under the age of 18 are considered minors and must be under the direct supervision of an adult or legal guardian at all times. We recommend that you contact our travel specialist in order to determine appropriate trips for children under the age of 18.

Please note that, due to the higher than normal physical requirements or long and arduous nature of travel conditions, some of our tours may have upper age restrictions.

Local Conditions

You acknowledge that you will be visiting places which may present certain risks, dangers and physical challenges greater than those present in your daily lives. By booking travel with BE Outdoors, you acknowledge that you have considered the potential risks, dangers and challenges, and expressly assume the risks attendant to such travel conditions. You are solely responsible for acquainting yourselves with customs, weather conditions, physical challenges and laws in effect at each stop along the itinerary. BE Outdoors does not assume any responsibility for schedule changes made by the airline, or any additional costs (accommodation, meals, etc) incurred due to any flight delays or misconnections.

Successors and Assigns

These Terms and Conditions shall inure to the benefit of and be binding upon the Company and the Client and their respective heirs, legal personal representatives, successors and assigns.

Details of changes to these terms and conditions

From time to time we may need to update, alter, modify or change our terms and conditions. We will publish changes on our website www.be-outdoors.com and you are responsible for checking whether these terms and conditions have been changed or updated. If you continue with your booking following any change we take this to mean that you accept the change.
